ESA Migration from Incapacity Benefit

people who are bieng migrated from incapacity benefit onto employment support allowance may be entitled to premiums which were only accessible to income support claimants before.
many migrants are missing out on income related ESA as they are not sent an ESA 3 out when migrating and so are losing out on benefits.
ESA3 forms for change of circumstances are not available to anyone as i am aware without telephoning the ESA helpline.
has anyone experienced this problem as if someone is living alone and on DLA may be entitled to premiums that they are not claiming income related ESA, only contributions based ESA.

Hi bb,

If a claimant was entitled to premiums in the form of an Income Support top-up, as well as their IB before being transferred over to ESA, they should receive Contribution Based ESA with an Income Related ESA top-up when/if they are successfully migrated over.

Transitional Protection should also ensure that they receive no less when migrated to ESA than they did before, see :

If a CB ESA in The WRAG recipient's payment is due to run out due to them exhausting their 365 day entitlement, they should be sent an ESA3, to see whether they qualify for IR ESA, see : Asset rule for ESA(IR)

If a current CB ESA recipient gains an award of Middle or Higher Rate Care of DLA, they should send copy of notice of the award to the DWP, they may well be entitled to an IR ESA top-up, depending on their personal financial circumstances.

Many people who were awared DLA whilst on incapacity benefit never claimed income support premiums so they are bieng missed for the income related premiums

Unfortuantely, that may well have been the case, where claimants were unaware that they may be entitled to disability premiums.
