i have my first work focused intrview on 3rd december 2012, i have appealed the decision to place me in the wrag instead of support group, on the grounds that the health care provider stated on my esa85 that i would be unable two work for at least 2years and that any improvement is unlikely in the longer term. is it likely that i could be punished for daring to appeal :( ? just say for example, by being sent for another medical? maybe i should have quit while i was ahead. thank you.

Appealing is a no-fault process which you are legally allowed to pursue, so there should be no reason why you should be assessed any earlier than expected.

I've looked back at your previous posts and Bro58 has posted links to our guides, but to be clear, to be placed in the Support Group, you need to meet one or more of the SG descriptors, a prognosis of being "unable two work for at least 2 years and that any improvement is unlikely in the longer term" is not sufficient in itself for you to be successful.

Further to gordon's helpful answer -

You have a right to appeal and cannot be punished in any way for doing so. However, yo must be certain in your own mind that your WRAG award is secure as their as a risk that the decision could be overturned so that you are found fit for work. This does not happen often, but it does need to be considered. The ESA85/85a should help you decide how safe the award is.

Hi mpj08,

The fact that your WRAG "prognosis" is "In the longer term" (2 years) "MAY" be a good indication that your WRAG award is reasonably safe.

If you have concerns regarding losing your WRAG award, you should seek face to face advice where they will be able to risk assess the possibility of endangering your WRAG award by appealing, see : Where to get advice?

However, at the end of the day, the decision will always be one that you will have to make yourself. :)
