hello... just wanted to point something out to people with a hearing disability. when i went for my esa medical assessment i failed the first time ,but was re-viewed and won my case. but what i didn't know at the time that as i have a hearing disability i should be assessed WITHOUT my hearing aid as a judged as a "normal " person., without my hearing aid i cannot hear.it says so in the disability act of 2008..so if you are going for your appeal .take out your hearing aid ,then when they ask why you can't hear them ,.tell the person assessing you that you have to be assessed without a hearing aid.you actually score at least 5 points there.if you lip read is even better..

I am afraid that you are mistaken here. :(

See this extract from page 85 of The WCA Handbook :


" Considering Hearing

The methods used to assess the ability to understand communication involve considering a person’s ability to hear a shout at one metre and their ability to lip read.The descriptors are intended to take into account hearing aids if normally worn. A “shout” is equivalent to 80dB of noise and therefore inability to hear a shout suggests a significant loss of hearing.

State the claimant's ability to wear a hearing aid. If the claimant has rejected the prescribed hearing aid then state the reason why. Bear in mind that a claimant who has been inconvenienced by a hearing aid and has abandoned it should be assessed without aids."

The DDA has been superceded by Equality Act 2010.

I think that you may be getting confused with fulfilling the definition of a disabled person under EA2010, with respect to "Deduced effect" in other words the person should be considered on how they would be and whether or not they would fulfill the definition, without using any aids or taking any medication that would be normally used/taken.

This is not applicable to the ESA Descriptors.
