Thanks for the reply Gordon.
Will they automatically send out all my documents before the appeal starts ?. Or will I have to push them As I really need to know how they have come to there decision in the descriptors and how they have pointed me thanks again.

Hi fg,

Do not miss the one month deadline to submit your appeal due to waiting for documents to arrive, which may not even exist.

Concentrate on showing how and why you qualify for the SG under at least one of the descriptors.

You could state in the GL24 that you are awaiting documentation that you have requested from the DWP, and will provide more information if applicable when the requested documentation arrives.

See : Qualifying for the Support Group

Yes thanks for that bro58 I will send off my GL24 tommorow hopefully I will Recieve the other info later,I need to know how they have pointed me in the Descriptors to fight my case.

Hi fg,

Although the documents may help, don't get too hung up on them, as many members seem to.

Concentrate on reiterating how and why you qualify for SG with respect to the descriptors.

Pointing out errors or incorrect assumptions in these documents will not necessarily qualify you for the SG.

Like most I have had a dreadful time transferring from IB to ESA, and getting any information from the DWP has been like pulling teeth. With the help of information gained from the B&W website the light at the end of the tunnel is now visible to me.

As brief background my WCA seemed to go ok, but I was put in the WRAG which I felt was wrong given my circumstances (physical\arthritic and depression). Further stress and anxiety was added because my ESA is Cont’ based and therefore it would then cease if I could not find appropriate work in 12 months. I would find this impossible to do and I would most likely end my life rather than become more financial burdensome on my family.

As I comprehensively explained my problems and enclosed this with my ESA50 I could not add anything to this whilst appealing by letter. Also I did not know what the decision maker had or had not considered. Despite my numerous requests the DWP have never provided me with any paperwork or records of the decision making or point scouring and my FOI request turned up useless information (in my case).

Coming to the end of my tether of being threatened by DWP staff for not attending wfi’s (I previously sent the dwp evidence of my difficulties attending wfi’s as outlined in there own ESA85 Dr’s report) I therefore made a complaint to my MP and whilst I await a response the DWP has sent me a reconsideration letter stating that I have been put in the support group for 3 years. So I’m relieved.

The experience has without doubt worsened my state of health and I know without the help of those close to me I could not have fought this battle.

The DWP don’t seem to know what they are doing and I have now been sent another rather intimidating letter outlining sanctions for not attending wfi’s (I’ll leave that for MP to deal with!)

Questions, If someone could be kind enough to answer are: I have previously requested information regarding the decision making process in my claim, none has been provided. Can I now request this information again given the successful outcome? If so should this be a specific foi request? or a letter stating some other entitlement. I fear I will have a similar tale to tell next time I claim, but this information would give me an understanding of what went wrong this time and what was put right. This may help me with a less stressful and appeal-less claim next time!

Thanks to all the help from this site

Duplicate post removed.

Please do not post duplicates, it just makes more work for the moderators and means that everything takes longer :)

Hi
I went through much the same nonsens. I sent an email to my Ombudsman (google DWP ombudsman) and got £25 compensation. Did not stop the errors though. In the end I got my MP involved but still took 18 months from date decision sent to me (to be put in WRAG) till a Tribunal hearing in my home yesterday. Thanks to this site and persisting I WON -AM NOW IN SUPPORT GROUP!!!! Don't give up. I can remember the trouble I had getting my medical report. I do know it has to be a leaflet GL24 for the appeal

Congratulations on being put into the support Group, and double congrats on the home Tribunal hearing, I was beginning to think they were an urban myth.

Allwornout

Apologies, it appears we missed your post earlier today.

You can make a Subject Access Request for your information, this is a formal request under the Data Protection Act, there's a guide on the following link

www.benefitsandwork.co.uk/help-for-claim...eneral-benefits-info

With regard your problems with WFIs. I don't want to add to your burdens, but this is not something you can ignore.

WFIs and Work Related Activity are a mandatory requirement for members of the WRAG, and you can be sanctioned for not participating. It's not clear from your post, whether you are already being sanctioned, but you need to be aware that a new sanction regime will be implemented from 3rd December, see

Changes to ESA Sanctions

I would not assume too much of your MP, whilst they can often be of assistance in speeding the process through and overcoming "road blocks", they cannot interfere in the legal processes of the DWP, the sactions are between you and the DWP, and only you will be able to resolve the matter.

If you have further questions, please reply to this thread.
