Please can you advise, I have been placed in the WRAG contribution based group starting in Jan 13. I intend to appeal, but could you tell me if there is anything I can do at the end of 365 days as my husband works fulltime. Without my benefit I can not pay for the care I need. I have migrated from IB but recieve high rate mobility & middle rate care DLA.
Many Thanks

I am afraid your options are extremely limited.

Based on what you have said, you will not qualify for ESA(IR) due to your husband working.

You will not be able to make a new claim for ESA(CB), because you will not have any NI Contributions in the necessary years because you have been transferred from IB.

The qualification rules for JSA are much the same for JSA as they are for ESA, so you will not qualify for this benefit either.

There may be changes resulting from the introduction of the Universal Credit next year, but I doubt this will help.

I would recommend you get face to face advice, if you can, next year once you have a better understanding of what is happening with your claim.

With regard an appeal, have a look at the following FAQs

Is there any risk to challenging a decision?

How long do I have to appeal?

How to submit an appeal

12 Month Limit for ESA(CB)

Do I have to attend WFIs while I appeal?

Thank you Gordon, just as I feared, still I know I have the full support of my GP, so will start appeals procedure, I really have nothing to lose. I knew I could rely on you to have the answer. Many thanks for the advice. Karen
