Good afternoon everyone.

I hope you are all well.

Unfortunately I have another little question with regards to the ESA procedure. I have looked at the excellent guide but I'm afraid clarification is still needed.

I have spoken to ATOS today and a helpful individual informed me that they did not require me to attend any assessments.

Can someone give me a clue as to what happens next? The ATOS guy told me that my papers have been returned to the DWP.

Am I to attend WFIs next?

Any help much appreciated, not sure where this one is going?

If ATOS don't require you to attend an assessment, then they believe that they can make a recommendation on your claim based on the information that you have supplied them.

In these circumstances, it would be unusual for the DWP Decision Maker not to accept their recommendation asis.

You can't be found Fit for Work if you do not attend an assessment, so it seems likely that you will be placed in one of the two ESA groups, the WRAG is more likely but it is possible to be put in the Support Group without an ATOS assessment, you will have to wait until the DWP contact you, to find out what is actually happing.

Hi,

I think this is what's happened to me.

I've received a letter saying I've been placed in the WRAG group purely on my form as I've not had a medical, all they have is my form.

So I take it I have been assessed as fit for work?

Yet my DLA was up for renewal in July & I was awarded high mobility & care which I have been on since 2006. The only difference this time was that the award was for life.

Will my DLA stop now?

Also if I ask for an explanation & written statement of reason will this give me more time to try & understand what is happening or do I have to ask for a reconsideration to gain more time?


One more question.

Can I submit more info for a reconsideration?

ESA is paid to those unfit to work. DLA is paid to those with mobility and/or care needs and many on DLA manage to work be it full-time or part-time.

Your DLA cannot be taken away from you unless a Decision Maker decides you no longer qualify for it, which is highly unlikely for someone on HRM & HRC indefinitely.

Solstice, you have been placed in the WRAG,this means that you have been deemed to be not fit for work at the moment but might be so in the short-to-medium term. You will be expected to take part in Work Focused Interviews, even if you decide to appeal

Work Focussed Interviews

You can request your ESA85a ( as you did not have a medical), this should give you an idea of how the DWP made this decision and when to expect reassessment. You do not have to be requesting an appeal in oder to do this.

If you ask for a reconsideration, or appeal (which we usually advise), you should send in as much additional info as you can.
