Hello there. I like the new streamlined look of this website.
One aspect of a persons inability to do things may be caused by another aspect of his disabilities. i.e. A persons mental health may stop him for doing some of the physical things in the 'mobility' part of the questionnaire. Do you think this would be taken into account when allocating points?
Also the questions don’t match up with what the law says in the Regulations/Schedules. Will the assessor expect the claimant to know the law or be surprised if he does? Thank you.

Hi R,

It should be.

It is quite true that a person may have resulting limitations as a result of mental health issues, these mental health issues may be caused by chronic and progressive physical health issues.

Therefore, points scored could arise in the physical and mental health sections of The ESA50, in this scenario.

You may score points on some, but not all of the physical descriptors if the underlying problems are due to Mental Health issues, it is all down to the wording of the actual descriptor.

For example; Question 8, Getting Around Safely, uses the phrase "due to sensory impairment", so you would not score points on this descriptor if you had problems going out because of issues with socialising.
