DLA not awarded

I have been turned down for DLA both mobility and care. The letter I received from DWP said the decision was arrived at after taking into consideration the info from my GPs surgery, the report from the ATOS GP who did my medical and the form I filled in. The letter says I can cook a main meal and have no trouble lifting pans. I stated to the ATOS GP that I could not do this. There are other discrepancies for mobilising, falling, needing someone with me when I go out etc. I need to contest this. Do I need to send a GL24 or do I ask them to reconsider. Would DWP turn people down as it could be a waste of time giving DLA awards when it will soon be changing to PIP. I'm not really sure what my next move is. Any help would be appreciated. Thank you.

Sorry to hear that your DLA claim was unsuccessful.

Firstly you may wish to request copy of the documents that The DWP DM used in coming to their decision, see : DLA Medical – What forms to ask for?

If you wish to appeal, you should do so using the GL24 Form which can be downloaded and printed off from the link on this page : How to submit an appeal

You have one month from the date of your DLA decision letter.

For potential sources of professional advice, see : Where to get advice?

Once you appeal you will receive an automatic reconsideration of the decision anyway, by a different more senor DM.

If the decision is not changed in your favour at that stage, you should be informed and your appeal should be automatically sent forward to The Appeals Tribunal Service.

If you do appeal, and are successful, the new decision will be backdated to the time of the original adverse decision. Further, if you could manage to obtain an indefinate award, indefinate DLA awards are not being migrated over to PIP until Oct 2015.
