Hi Forum
The brown envelope hit the front door mat recently, have been placed in wrag from IB, no medical, that was something to be glad of, THANKS for the helpful info from B&W on filling in the esa50 it was a great help.
I have telephoned the number on the decision form and it goes to a "contact centre" where I was greeted by a lady who gave the robot like speech about the difference between wrag & SG placeing.
After a short conversation I started asking questions which she had no real answer for such as how did the decission arrive to put me into the wrag group when I have a minimun of two of the discriptors required for the SG.
She said I should appeal, seemed very open about it too, seems very odd to hear this.

Cant help thinking that dwp just put people like me in the wrag and hope that we wont do anything about it, just except it, end off.
They must know that I have some of the required descriptors for the SG but just ignore them and hope we will go away, thats how I feel !!!

So, should I ask for reconsideration of the decission OR just go straight for an appeal ?

I understand that it is possible to have my wrag status removed but could not see why this would occur at an appeal, dont know if anyone has had this happen on this forum ?

I have asked the contact centre for a copy of my eas85A and the lady said that she would send a request to the revelant office dealing with my claim, with Christmas coming up I bet I wont see that esa85A for some time, so having read on past threads to not wait for paper work to arrive but to get a appeal in before the date on the decission letter which was six days old by the time it arrived, I made sure this was duly noted by the contact centre.

So, basic question is either to send in an appeal OR ask for a reconsideration ? whats the real difference between the two choices ? I appreciate an appeal you are required to go infront of a panel to be asked questions etc, are there any pitfalls of either ?

There doesn't seem to be any benefit on requesting a Reconisderation in preference to an appeal, and it certain to make the process longer, if you do actually go to appeal, so our recommendation is always to appeal from the outset.

If you appeal a Reconsideration has to be done first anyway, so you lose nothing from this perspective, and you can always withdraw from an appeal with no fault should the need arise.

I can't quantify the risk of your award being withdrawn, it most certainly can happen as we have seen it, but if adds any comfort to you makeing a decision on this, you cannot be found Fit for Work without a face to face assessment.

With regard the DWP call centre staff, they are very good at handling maintenance issues with your claim and receiving requests for documentation, but I would not bother trying to discuss appeals or Reconsiderations with them.
