IB to wrag questions was created by john
I was put straight into wrag from IB. On 7 Dec I asked for a reconsideration a statement of reasons and an appeal form. By 17 Dec I had still not heard anything so rang again. I was told there should have been an appeal form with my letter informing me of being put into wrag, but there wasn't. I asked why I had not received the information I had asked for and the reply was "I don't know". I am still waiting. I went to see my doctor on 13 December for my check up and told him what was happening. He is furious and signed a fitness form for 6 months saying he would need to reassess me then. He was going to write one for 12 months but thought they would be funny about that. My doctor insists I am not fit for work and never will be but I have 10 years before retirement age. My doctor said he will sign fit forms for me every 6 months, will that put me into the support group? According to the descriptors on here that is where I should be. Also should I send the fit note in with the appeal papers ?-if I ever get them. This is all worrying me into the ground

Please create a new topic when you have a question, tagging your post onto someone else's post just causes confusion and can mean that you receive the wrong advice for your situation.

Having been placed in the WRAG, you are by definition classed as being not fit for work, so I am afraid your GP's Fit Notes will have no effect to your situation.

Further, having been placed in the WRAG you cannot be asked to work or to seek work.

However, you are required, as a result of your award to participate in Work Related Activity. Any request must take into account any limitations implied by your condition(s). It may be possible for your GP to write to your JC+ advisor stating that you should be excused a specific WRA activity, but this is untested.

WRA is not clearly defined bu the following FAQs may give you some idea as to what you will be asked to undertake.

You need to be aware that failing to participate in WRA, where it is reasonable for you to do so, can lead to the sanctioning of your benefit.

So unless I win an appeal my money will stop in 12 months because my wife works? What happens then if my doctor signs fit notes? At present I receive high rate dla - both for care and mobility

If your wife works more than 24 hours per week or her income is more than the amount the law says you should have to live on, then yes, your payments will stop as you will not be eligible for Income Related ESA.

You cannot appeal the Decision on the basis that your payments will be stopped, only on the basis that you meet one of more of the requirements for the Support Group, see

Qualifying for the Support Group

Whilst they may be of assistance in showing a level of disability, your DLA awards do not entitle you to an ESA award of any level.

The limitation does not close your claim, you remain eligible for ESA, just not entitled to payment, so this is not an issue of your being found Fit for Work, you remain Unfit for Work, so there is nothing that your GP can do.

Thank you for explaining that Gordon. Unfortunately I don't know what I will do I know I am not physically capable of going to work. All of this is having a mental effect on me as well. I already suffer with depression. I just can't see a way out of this mess now - perhaps its just not worth trying there's nothing I can do, I have no future at all now. Thanks again

If the stress and worry of being in the WRAG causes your condition(s) to deteriorate such that you meet the criteria for the Support Group, then you can ask to be re-assessed, this can be done in parallel to any appeal that you might be considering.
