Hi Forum
Have requested my esa85A, was wondering if this report contains how many points were scored and in which descriptor, also the reason why I have been put into a certain group.

If the esa85A is just a written report and nothing else is it possible to find how many points I scored and the reason I was put into a certain group ?

Hi Dq,

You would be lucky yo find any substantial details in the ESA85A, they can be most vague.

It may state things such as "the claimant meets the threashold of LCW" (WRAG), it may mention that none of the Schedule 3 (SG) descriptors apply if you didn't qualify for SG.

It tends to state the descriptors that do not apply more than the ones that do, therefore it may be possible to work things out by the law of elimination.

On the whole the ESA85A, contains a lot of elctronically generated LiMA phrases, and once the ATOS HCP has reached the conclusion that you have scored the minimum 15 points required to enter WRAG, they tend to leave it at that.
(unless you also qualify for SG)

It should also contain the "Prognosis" recommended length of your award, on the other hand it may simply state as the prognosis, "In longer term" leaving it upto the DM to decide.

It is still worth requesting it, which can be done over the phone by ringing the Benefits Office that is dealing with your ESA.(Best to back up in writing)

There will almost certainly be an LT54, which may contain relevant information.

There may also be an : ESA72 Form , or an : ESA 113 Questionnaire

It may be advisable to request all forms and documentation that was used in coming to the decision, including eletronic.

To cover all eventualities, I would specifically request information regarding how and why you were given the ESA award, and the length of the prognosis, just in case it is not written in any of the above.

Thanks for the reply, I requested the esa85A via phone from the "contact centre" when I received the letter stating which group I had been put into, this request was only verbal.

Do I need to use the SAR form for the related forms you have mentioned ? if so should I post it the address where they are dealing with my claim ??? ... or again is it a matter of using the "contact centre" to request these forms, I have the esa113 from the doctors as I requested my medical records cant decode the writeing from the doctor :laugh:

Maybe it would be better to send direct to the office dealing with my claim and ask for ALL documents relating to the decision.

Where do these SAR forms come from do CAB offices have them ?

Hi Dq,

Yes you should post it to the office address on your ESA award letter.

If you want it to be treated as a formal SAR under Data Protection Act 1998, you can either just wtite a letter listing what you are requesting, or you could download and print off a SAR Form from this link : www.dwp.gov.uk/docs/request-for-personal-information.rtf

On this webpage : www.dwp.gov.uk/privacy-policy/data-protection/

If you are to use The SAR form, then you could add a letter stipulating that you wish to know the reasons for your award, as previously discussed, and the progosis.

I would also write SAR Data Protection Request in the top left hand corner of the envelope, they then have 40 calender days to comply, from receipt.

Thanks for the reply and useful info's its appreciated very much, have made a copy of the letter template for request of documents etc.

These esa forms seem to be invented as they go along, there must be a offiice tucked away some where with someone inventing new esa forms :)

If I do go to appeal am I correct in thinking that while I am going through the appeal system my eas payment will drop to £71 p/week ? or would I stay on my current amount ?
