Re physical activities no 1-10 was created by sally-jane
From 28th January 2013 the Employment and Support Allowance regulations will change yet again.
All the physical activities (numbers 1 to 10) are now amended so that they are assessed ‘on the basis that the claimant is wearing any prosthesis with which they are fitted, or that claimants are wearing or using any aid or appliance which they can normally, or could reasonably be expected to, wear or use’’

Could someone please answer these questions pertaining to the above?

1. Would that now really mean everyone will now get an Occupational Therapy assessment in order to determine what they might reasonably use to assist them ???
2. How will this change things how we complete the form from the previous form.?
3. Please give an example so we can fully understand it in laymen’s terms.
4. Will this only affect those completing a form from28 th January 2013 ?
5. Will this affect those who have been already been placed in 1 –3-year term on ESA/ WRAG/SG affective fro pre Dec 2012.

From 28th January 2013 the Employment and Support Allowance regulations will change yet again.

The physical activities (numbers 1 to 10) must now be satisfied on the basis of a specific ‘bodily disease or disablement’

Could someone please answer these questions pertaining to the above?

1. Would this mean we require a GP or other to provide us with a specific diagnosis/disability?
2. How will this change things how we complete the form from the previous form.?
3. Please give an example so we can fully understand it in laymen’s terms.
4. Will this only affect those completing a form from 28th January 2013 ?
5. Will this affect those who have been already been placed in 1 –3-year term on ESA/ WRAG/SG affective fro pre Dec 2012

The mental, cognitive and intellectual activities (numbers 11 to 17) must now be satisfied on the basis of a specific ‘mental disease or disablement’ disease.

Surely Mental health symptoms will require a mental health diagnosis ???.

Could someone please answer these questions pertaining to the above?

2. Please give an example so we can fully understand it in laymen’s terms.
3. Will this only affect those completing a form from 28th January 2013 ?
4. Will this affect those who have been already been placed in 1 –3-year term on ESA/ WRAG/SG affective fro pre Dec 2012.

From 28th January 2013 the Employment and Support Allowance regulations will change yet again. Activity 2 now includes an ‘adjustable chair’ and formally clarifies that the test is now a combination of sitting and standing.

Could someone please answer these questions pertaining to the above?

2. Please give an example so we can fully understand it in laymen’s terms.
3. Will this only affect those completing a form from 28th January 2013 ?
4. Will this affect those who have been already been placed in 1 –3-year term on ESA/ WRAG/SG affective fro pre Dec 2012.

From 28th January 2013 the Employment and Support Allowance regulations will change yet again, Activity 7 has now been changed so that communication by verbal means alone and non-verbal means alone or a ‘combination’ of the two is considered.

Could someone please answer these questions pertaining to the above?

3. Will this only affect those completing a form from 28th January 2013 ?

From 28th January 2013 the Employment and Support Allowance regulations will change yet again,
The exceptional circumstances provision in Regulation 29 has also been changed. Trying to show that a claimant would be at ‘substantial risk’ in a workplace now also will involve considering whether any ‘reasonable adjustments’ in the workplace or prescribed medication would significantly reduce such a risk.

Could someone please answer these questions pertaining to the above?

3. Will this only affect those completing a form from 28th January 2013 ?
