Self-employed under JSA have to migrate to ESA

OK, so you are now claiming ESA.

Unless you have paid sufficient Class 2 NI Contributions in what are referred to as the qualifying years, you will not be eligible for Contribution Based ESA, only Income Related ESA.

Your eligibility for ESA(IR) is dependant on your income, any assets you own. including, it would appear, those from your business, and how many hours your partner works (if you have one). If you are unable to satisfy this means test your claim for ESA cannot be progressed, so you need to return this form with as many of the details provided as possibe, and where you cannot, you must explain why.

In goal to save time should already informed ESA department that I could not provide some documents by explaining the reasons (stolen documents) when I will send this form www.dwp.gov.uk/docs/esa1.pdf OR should i wait they send me a letter requesting these documents after reception of this last?

How long it should take? Will my present Housing Benefit be stopped at the same time than the JSA?

If you have care and/or mobility needs then you can make a claim for DLA.

You must have had these needs for at least three months and expect to have them for at least a further six months.

Any claim for DLA can be made in parallel to your ESA claim.

I would send details with the form, although it is likely that they will still send a request for the documents.

Providing the DWP are aware that you have closed your JSA claim in order to claim ESA, your HB should continue, however, if you did not do this, then the DWP will have notified your Local Authority. You should be able to get it re-instated by giving them a call after Christmas, this can either be a zero income claim or if it is sorted, because of your ESA claim.
