Having read the esa appeals section which has been very helpful, I have some questions that someone may be able to put an answer to.

Q1 Under "reasons" on the GL24 should I just put the revelent discriptors i.e. there numbers and sub numbers that I believe I fulfill in order to be placed into the SG and then give my reasons in full detail or be brief as to why I believe I should be in the SG ?

Q2 As I am sending some medical reports/documents with the GL24 is it wise to send a covering letter with detailed explanation of the medical reports/documents as they cover different conditions at verious times/dates.

Q3 If I put a covering letter in with the GL24 giving a history of when my conditions started and how my conditions have progressed till the present time, is it a wise move to give as much info at this stage as when the appeal is seen there is a reconsideration process given to the origional decision.

At this stage I do not have a score sheet or any reasons from the dwp as to how the decision came to be made but will have those shortly, but right now owing to the Christmas post my return date for an appeal is getting close.
I did ring the "contact centre" and ther attitude was dont worry about the date on the letter for returning, easy for them to say that, I tried to get them to send me some proof that I had previously informed them the decision letter was a week late arriving from the date inside but they would not send anything on paper as proof of my origional complaint regarding post delays.

So, now have to hurry up to get inside there unrealistic target date !!!!!!!!!!!!!

Any thoughts on above Q's would be appreciated.

In answer to your questions

1. Yes you can refer to the ESA descriptors you believe that meet, however, you do not have to go ino detail on your GL24 as to why you want to make an appeal.

2. Yes, I would recommend sending a covering letter, most claimants send in the GL24 seperately from any submission that they might want to make.

3. There is an opportunity to overturn the Decision at the Reconsideration stage, given that appeals are still taking six months or more to be heard, there is value in trying to overturn the Decision at this stage.

You don't say whether you are appealing a Fit for Work Decision or to be placed in the Support Group from WRAG, if the latter then you need to be aware of the following

Is there any risk to challenging a decision?

Hi Dq,

Q1. Yes, this is a good idea, and there is no reason why you shouldn't.

Q2. Good idea again, you may wish to provide an index, and cross reference any evidence to the relevant limitations, and qualifying descriptors. Don't forget to send copies only, and put your Name, Ni Number, and DOB, on every seperate page.

Q3. Again this should help. There is no advantage to holding back with any evidence that you may have at this stage. After all, the best possible outcome would be to be placed into the SG at the automatic reconsideration stage, therefore avoiding, a lengthy wait for an appeal hearing.

You should provide all the evidence that you have at the earliest opportunity, the DWP have stated that one of the main reasons for the number of successful appeals is the fact that the claimant is not providing the evidence for the DM's to reconsider.

I would not miss the one month deadline, if you have not received the documents that you have requested in time, make a note on the GL24 stating this, and that you will provide any fresh evidence with respect to the documents as soon as you receive them.

Thanks for your speedy reply Gordon, Yes I am appealing for move from wrag to SG, sorry should have said.

Yes, the risk factor, a difficult one to weigh up, having been placed into wrag they must realise that I am not fit for work.

It is always at the back of your mind isnt it, that they could take away all esa, not sure of the percentage it has happend to hopfully not many.

I will probably have some more Q's tomorrow.

I'm not aware of any statistics covering this, I can say that it has happened to B&W members, but it is not frequent, factors that you might want to consider are the number of points you scored (assuming you can find this out) and how many different descriptors you met, most importantly, if you did not have a face to face assessment then you cannot be found Fit for Work.

Thanks, Bro58 & Gordon for your replys, always good to hear another opinion on what I think etc as many good point and ideas come from many minds :)

Bro58, have taken your idea of making an index related letter starting from my first problem and as I now have my medical records from gp, I can at least form some sort of resume over a given period of the problems showing the path to present.

When I start writing I intend to do to much of it :) will do a draft then edit to final, will be sure to link to descriptors as and when possible.

As you say its now or never at the GL24 stage, so who knows what will come out of it ...

As yet I do not know where I did or did not score points ... so, I am just sticking to what descriptors I believe apply to my case and submit enough medical reports + the above letter to see if this will help my appeal.

At least I will have the appeal lodged in place, just one more to there pile of ever increasing appeal mountain :)
