hi all, i had an atos medical back in june.after calls and letters to dwp i finally got a letter and atos report letter dated 26th oct. letter stated i have been put in the wrag group,as i want to appeal this i got everything together and was posted 19th dec.got a letter from dwp a week later wanting to know why its taken me so long to put in an appeal.starting to think it must be me. what a bunch...

Appeals should normally be lodged within one month of the date of the Decision you wish to appeal. It is possible to lodge a late appeal but you need to provide Good Cause as to why it is late. From your post, I surmise you did not do this.

Have you responded to the DWP's request as to why the appeal is late? If you have not, you need to do so as a matter of urgency, or your appeal may be lapsed, the fact that you were waiting for documents from the DWP may be sufficient, but you will likely have to explain why it then took you from 26/10 to 19/12 to make the request.

sorry gordon got dates mixed up it was 26.11.12 when i got letter trlling me i was in the wrag group.so now you can see what i was talking about.

Just to confirm, it is the date of the letter that is relevant not when you received it, so are you saying the letter was dated 26/11/12, if so, then there would be no reason for the DWP to query why the appeal was late based on your requesting one on 19/12/12.

Whatever the situation, you still need to respond to the DWP, either to explain why it is late, or to confirm that it is not, as the DWP will not progress your appeal without you doing so.

i sent acopy of the letter dated 26.11.12 back to dwp asking for an explanation as to why they could consider it late.
