I apologise if this is not in the correct forum ...
My son is epileptic and was placed in the WRAG group after being assessed last April by ACTOS
Just after that he was called to the local job centre wnere the nassessor talked to him about possible ays of getting back into work. After chatting with my son and his wife he said there was little he could do for him as the seizures were not controlled fully and he had no warnings when they were coming on and said he was surprised he had not been put into the support group and adbvised them to appeal the decision and that he would not be called for another 2 years ...

My son did this and we requested the ATOS papers.. When they arrived there were a few things the nurse had left out, including my son and myself telling her that he was losing memory after the seizures which were becoming more frequent and a couple other things, so we went ahead and requested a tribunal ..... still waiting ! However my son has now been called again to the job centre for a 'chat' - just 9 months after he was first there... does this happen very often? Unfortunately this puts more stress on him with the likelyhood of seizures which ar sometimes brought on my stress ..
Any comments would be very helpful .... and is 9 months a general wait for an appeal ?

It is not unusual for claimants to wait for around a year for an appeal to be heard - less in some areas, more in others.

How long to hear an appeal?

Whilst appealing the claimant is still expected to undertake work focused activities (that is the whole basis of the WRAG after all!). These can be postponed or held over the phone (or even in the claimant's home) but this is entirely at the discretion of the JobCentre advisor, the claimant cannot demand this.

Do I have to attend WFIs while I appeal?

For someone with epilepsy,getting into the Support Group is mainly down to the frquency of fits

Sorry to correct you Mrs H, but there is no Support Group descriptor that corresponds to the WRAG "Staying Conscious when awake" descriptor.

Valerie your son will need to qualify for the Support Group through something else other than his epilepsy, unless you can show that he meets the Exceptional Circumstances because of it.

OK thank you both for your help .... he does have anxiety and stress but thinks it is not something to mention as it is caused by the seizures, they are quite frequent and he also has night ones .... his wife gets carers allowance for him and he gets low level mobility and full care component of DLA, which will run out shortly, so yet more worries for him when that arrives again ...
