DLA556 Change in circumstances was created by T1212
Hi all,

We recieved one of these over christmas due to a change ion my mum's circumstances. She origonally claimed under the Special Rules.

I guess now as she is not classed as terminally ill, we have been asked to fill this in.

I have downloaded the guides form this site, which are all extremely helpful, and quite frankly, don't know what we would have done without it.

We are just about ready to send the completed form off.
Just wondered if any other members have had this form and or know of any outcomes.

There are two issues that you need to consider before returning the forms.

First, to "qualify" under the Special Rules there must be an expectation that death will occur within six months, just because your mother has not died to date (sorry for being indelicate), does not mean that there is still not an expectation that she will within the required six months. If this is still the case then you should speak to her GP who should be able to issue a new DS1500.

Secondly, if death is no longer expected within six months, she no longer qualfies under the Special Rules, and consequently no longer qualifies for DLA! This being the case then you need to treat the Change of Circumstances as a new claim for DLA, and complete the form in detail and provide any and all relevant evidence.

Have you tried to get face to face assistance with this, either from your local CAB, Welfare Rights, or if her condition is one supported by a charit,y and advisors that they can provide?

If you need additional time to complete the forms, you should be able to get and extension from the DWP, but as always, you need it confirmed in writing.

Thank you for the reply Gordon.

My mum has extremely limited mobility problems caused by severe osteo arthritis in her kneck, shoulders, back, knees, feet and toes.

This has been the case since 2003, she also has an ileostomy, so that combined with limited mobility means she needs extra care too.

The only thing that has changed would be that she is not in any danger of dying soon, we hope.

However, due to the nature of her bowel removal (cancer), there is still a section remaining that will never show signs of a re-occurance of the disease, so she has to have CT scans and colonoscopy’s every 2 years and will never be discharged from the cancer clinic.

So really we are making the new claim based on her severely limited mobility, and because of this, needing help with her stoma care.

We have completed, in great detail, extra additional information sheets for most of the Q’s and her GP, who has looked at the info, has said he will back up everything we have written should they contact him further.

The GP did say that the information was very comprehensive and that not many people bother to this extent. We compiled it by joining your group and paying for the downloadable guides.

So, yes, I think she should be getting DLA, I only posted here to ask if anyone had the same experience and what the outcome of their claim was.

Just thought I'd update on the above.

Received a letter yesterday stating Mum is receiving the correct amount of money and her payments would remain the same.

However, there was no end date on the letter, so called and spoke to someone about it. I was advised that everything will remain the same as before including the "indefinate" period but will probably be subject to reviews, like the one completed, in the future.

I filled the DLA556 "Looking at your claim again" claim pack in on my own with ONLY the help of the guides purchased from this site.

I didn't get any constructive advice from anyone here on the forum, except to say my mum shouldn't be receiving DLA!.... probably not the best advice, IMO, when the full details of the claim are unknown.

However, the guides I purchased were invaluable to me and would not have be able to complete the claim on my own without them....thank you for providing such comprehensive guides to purchase.

I would recommend anyone to buy these....thanks again.

T & Mum :)
