Hi

I am hoping someone may be able to help with some advice.

My partner has a medical next week, on Mental health Grounds, Anxiety, Depression, and Social Phobia; we went to see the doctor yesterday who was very sympathetic and advised us that we would just have to go through with it and probably appeal afterwards; She gave us a copy of the ESA113 that had been filled out by another Doctor in the practice, and I'm shocked that he has put so little information on the form, and what he has, And Hasn't put just flies in the face of what we have put on the ESA50.

She is being transferred from IB to ESA but she has not seen anyone for her condition for many years because 1. Cutbacks in the local Mental health services and 2. She has never used medication because it was found to be of no use.

He has put that Diagnosis was in 1987 which is true, and what is considered her difficulties are which is true, but then put that she was hospitalised in 1995 which is true, and that is the last thing written, even though she was in day care up until 2005, and has not filled in any of the boxes on the second page..........I'm really angry, as it's obvious that he hasn't even bothered to look at her medical records and see what has really happened..........It just makes it look like what she put on the ESA50 to be untrue even though it is exactly how things are, unfortunately, she has not had any major issues since we have been with this particular practice.

The doctor we saw yesterday did say to see her after the Medical, when she will have had time to have had a look at M's medical records properly, but she is unaware of the problem with the ESA50 filled out by her colleague.

All I see at the moment is my partner getting more and more stressed at the thought of this medical, and I'm worried she will crash if she gets found fit to work.

If anyone could give some advice we'd be most appreciative

I'm unsrure what advice you are looking for. :)

You say "It just makes it look like what she put on the ESA50 to be untrue" but then go onto to say "even though it is exactly how things are" :unsure:

If you believe there are errors in the ESA113 then you could make a complaint to the Practice Manager.

If you disagree with the contents of the ESA113 or there omissions, then you could write to the DWP to correct the problems, you should also take a copy of this letter to her assessment and ask the ATOS assessor to read it beofre the interview.

In a broader sense, this is just one of a number of pieces of evidence that will be considered in order to make a decision on her claim, The Decision Maker will primarily use the ESA85 medical report that will be produced after the assessment, but must take into account her ESA50 and any evidence you have attached to it.

Thank you for the reply Gordon.

Apologies when I said "even though it is exactly how things are" I should have said is what she put on the ESA50 is how things are, and what the Doctor had written/ Not written, are very uninformed as to what my partners difficulties are, I.E. nothing very supportive of much more recent problems than 1995.

The other advice is very helpful, although I do feel that it will end up in a appeal.

We will probably wait to see the doctor after the medical, and hopefully she can support us with a better informed view of things.

P.S. I have also just been watching the Parliament debate, And I cannot believe the Ministers reply so far, they seem so blinkered.

Unfortunately, whilst GPs are obligated to respond to an ESA113, very few approach it with any vigour and/or rigour, and it is not uncommon for another GP to complete the form, never having seen the claimant.
