Hiya,

Im a bit puzzled by the changes. Can you clarify if a person received there esa form before the 28/1, but is not due to be sent back till after the 28/1, will they be assessed the old way or will they be assessed under the new changes.

You should be assessed using the current Regulations and Descriptors if the ESA50 is issued before 28/01/13.

Thanks gordon,

I was thinking that as it wont be returned till february, then it would be under the new 28/1 changes.

I am in a bit of a pickle with my esa form and the dwp and atos at the moment, and am not sure if my form will be filled in or not. I am waiting to see a welfare rights person.

Do you think it is better?.

I do not think we can offer any more advice than we already have in regard to this errant ESA50 form, especially if you are trying to get face to face advice.
