Just been put on wrag (CB) but am appealing. Want to know if appeal fails after being on the above for 12 months what will i be on next? Will amount of money paid to me every fortnight increase or decrease. Having been mitigated from incapacity benefit (been on since 1991)is my ill health retirement pension still not taken into account.

Hi S,

As this appears to be your first post on the forum, : Welcome to Benefits and Work :)

As your payment in the WRAG seems to be CB ESA, you will only receive this for 365 days from the date of the award : 12 Month Limit for ESA(CB) , this 365 day clock has now started ticking, and your payments would cease after 365 days, even if your appeal has not yet been heard.

If you are successfully placed into The SG, this revised award will be backdated to the date of The WRAG award, your 365 day clock will be reset to zero, and you will continue to receive payment in The SG for as long as you remain in it.

When your 365 day entitlement is coming to an end, you should be invited to make a claim for IR ESA, by filling in an ESA3 Form : Sample ESA 3 Form , you will have to pass a "Means Test" and not have over £16,000 in capital, assets or savings. (no deductions are made if £6000 or less), see :

Asset rule for ESA(IR)

&

24 hour work rule for ESA(IR)

Your pension would be classed as household income with respect to the "Means Test" and IR ESA.

In case you have not previously done so, you may wish to read our : ESA Claims Guides , our : ESA FAQ’s and our : Appeals FAQ’s
