Hi
a freind just emailed me to say she received a letter from atos warning her she needs to send her esa questionnaire back urgently as they have not yet received it. Her deadline date's end of next week.
Thing is she's not even received the questionnaire!! She's not good with phoning them dwp/atos to explain she's not received it.
Do the DWP/ATOS consider it legally posted even if they claim to have sent it but she's not got it in the post. Given it's proably lost god knows where in the postal system somewhere what recourse does she have ?
Advice appreciated.

I would advise that your friend e-mails ATOS ASAP, to explain that they have not received the ESA50.

It seems that The DWP/ATOS only have to prove that they have posted documents such as an ESA50 out to a claimant for there to be a presumption that the claimant has received it.
It can be very difficult to prove otherwise. There is currently a discussion thread on this issue on rightsnet, see : www.rightsnet.org.uk/forums/viewthread/4275/
It is normal procedure to send out a reminder letter one week before the ESA50 return deadline.
Another alternative, could be to try and fill in the PDF ESA50 and return it as soon as possible.

Whatever your friend decides to do, they should e-mail ATOS ASAP to create a paper trail.
They could also involve their M.P. : Contacting your MP
