Query re if condition gets worse after an appeal

Hi

If I am put in the ESA WRAG for a particular condition, and were to appeal because I feel that I qualify for being put in the Support Group, but were to lose my appeal and have to remain in the WRAG - if that same particular condition were to get even worse than it is now, i.e. further down the line - would I be at liberty to ask to be reassessed on the basis of that condition getting even worse - or would having lost the appeal be essentially the end of the matter? (Assuming that I have remained in the WRAG (CB) for all the time leading up to my condition getting even worse.)

I appreciate that I am jumping the gun somewhat in asking this now, but I want to mull over my options as I feel that I am likely to be put in the WRAG even though, from the descriptors, I reckon my urge incontinence should qualify me to be put in the support group.

I appreciate that no one can advise specifically about my particular case, but I would be very grateful to hear of others' views of and experiences in similar circumstances. Thanks in anticipation.

Yes, you could request a supersession which is basically a review of your current award at that time, if you had new conditions or your existing conditions had deteriorated.

This is the advantage of not opting out of ESA when your CB ESA payments cease due to your 365 day entitlement being exhausted, even if you are only receiving NI Credits for the purposes of State Pension.

As long as you have a current "live" WRAG assessment (LCW) which has been continuous, you can request a supersession to gain entry to the SG.

Whilst in receipt of NI Credits only, you will still have to fill in ESA50's and comply with face to face assessments etc if required, but you would not have to comply with any WFI's & WRA.

If you were then successful in being placed into The SG your CB ESA payments would be reinstated for as long as you remained in The SG.

However, if as a result of any subsequent reassessment after gaining entry to The SG, you were again placed into The WRAG, your CB ESA payments would cease once more, as you had previously exhausted your 365 day entitlement to CB ESA in The WRAG.
