Atos requested reconsideration was created by sandra
Atos has sent a letter to WPD to inform DM that they may want to reconsider the decision made because after my complaint they found lack of clarification in my functions and admitted the HCP had no understanding of the illness,which she referred to using the incorrect name. I have now received a letter to say that this information has been added to my appeal papers and will be forwarded to an appeal writer for further consideration. Will I have to get in touch with the appeals department to see whats going to happen or just wait for a tribunal date?

Hi S,

That's a bit of positive news. :)

All parties in The Appeal, i.e., you, The DWP and The Tribunal Panel should be provided with copy of any evidence that may be used at the hearing, prior to the hearing.

You may wish to contact The Tribunal Service that are dealing with your appeal. to query this.

Many thanks for your reply. I am hoping that its good news! I dont now how long this will take but at least they have admitted to the errors and said the HCP has been dealt with. I should think so!

You have the option of referring the HCP to their regulatory body if you believe that their 'standard of care' fell below the level that you are entitled to expect.

Can I just ask have you the right to find out he name and credentials of HCP that carried out your WCA if you find that the standard of it was poor and wish to report them to their particular regulatory body?

Also are you allowed to ask prior to the WCA starting what the name and qualifications are of the HCP carrying out the WCA?

Hi G,

Yes if an ESA85A has been generated in a paper assessment, the ATOS HCP should sign the report, and state what there status is, Nurse, Doctor, etc.

You can then request further information regarding the HCP's background and training from ATOS.

In the case of a face to face, they are supposed to wear a name badge stating "what" they are, and you are perfectly within your rights to request the further information that you refer to.

If it was a Nurse or Midwife, you could check them out on The NMC Register, and even make a complaint : www.nmc-uk.org/General-public/
