New ESA Claim

New ESA Claim was created by Peter
I was told by DWP in February 2012 that if I had to claim ESA again within 2 years I would go back into the WRAG. I became unwell 6 months into my new job and am having to claim ESA again, but I understand the 2-year rule no longer applies. Is this correct?

Also, I telephoned DWP today to make my ESA claim but after taking my name and address the adviser told me that due to a technical issue they cannot continue with my claim over the phone and will send me a form in the post. I thought that ESA claims were taken in full over the phone?

I'd appreciate your feedback, thanks.

Yes, the 104 week linking rule was rescinded at the beginning of last year, so this will be treated as a new claim with no reference to your previous claim.

I can not comment on the problems with the DWP taking your claim over the phone, however, even if they had, they would still have sent you the form to check and sign, and there may be documentation that they will require from you as well, so I do not think you have been significantly disadvanted by this.
