Any such order would have come from the Tribunal Service, I would have expected you to have been notified in advance of ATOS contacting you and I would have expected any letter from ATOS to have referenced such a Tribunal request.

Have you contacted the DWP about this yet?

Gordon or anyone else who might answer me,if you want to post all the message then do so,if you want to post some of it or none at all then do so as you feel best

I am so confused and don't know wether to go for this assessment that atos had sent for me(its tommorrow).

I travelled to a CAB further away from my home town because i did'nt,as you saw in a previous post in this thread have any help from my local CAB.The Cab i went to as still in my area,just 8 miles further to get to.

UPDATE

My CAB advisor phoned the DWP,while i was there.The DWP informed him(don't forget,this is the first time i had heard of this next bit)The DWP informed him that my case was re-considered on the 27th Dec 2012 and on that reconsideration they decided that they won't send in my appeal(which i thought they'd already done).They had decided that i should never have been on ESA assessment rate and all this time.from july 2012,i should have been kept on incapacity benefit,which they say they are investigating why i have'nt been and so will pay me what they owe me from when they put me on the assessment rate.This they should do whatever the outcome of tomorrows assessment.I've had no new ESA50 or anything.I'm at my wits end with all this,i just don't know what to do.They've left me no time to ask for it recorded ar anything.I can feel my health deteriorating through it all.Sorry for this.

On the basis of what you have been told, then you need to attend this appointment tomorrow, if you cannot, then you should ask for it to be re-arranged, but you can only do this once.

What has happened is that the DWP have decided that the original Decision on your claim (July 2012) was not carried out correctly in some way, and as a result of this your transfer from IB to ESA is being restarted, this assessment is in connection with this.

Your appeal will have been lapsed as the Decision you appealed is no longer valid, and you will received back payments for the difference between your IB rate and the ESA assessment rate, also the 365 day time limit on your claim has been reset to zero.

I hope this explains it and god luck for tomorrow.

P.S. why have the DWP not informed me about any of it though,until CAB phoned.
