Cold Weather Payment whilst appealing was created by Mr Kailash Shah
Hello! My first post as a new member. My ESA was stopped in early December last year and after appealing against the decision, my ESA has been reinstated at the rate of £111.45 (couple rate I believe). There was a cold weather trigger between November last year and Feb 5 this year, but I was denied this payment with ESA saying I need to be receiving ESA for at least 14 weeks. Is this right?? I have been paid continuously from the date my ESA was stopped, there isn't any break or anything. Should I be entitled to receive CWP? If so, how do I convince ESA? I have spoken with them and they denied the entitlement and were quite rude and unprofessional. Can someone please help? Thank you.

Welcome to the forum, you might want to have a look at the following FAQ

Welcome to Benefits and Work

We do not really deal with Cold Weather payments, but I will do my best.

CWP are only paid to members of the WRAG or the Support Group, if you are still waiting for your appeal to be heard, then you are not classed as being in one of these groups, and are therefore not eligible for payment. If you win your appeal, then because the Decision is retrospective, the CWP would become payable.

I notice that your forum name may be your real name if your want to change it then please follow the instructions in the following

My full name is showing, how can I stop it?

I hope this explains it.

Cold weather payments are only paid if you are in receipt of IR Benefits and not CB Benefits

As the OP has posted they are receiving the couples rate this would mean that they are on Income Related ESA.
