Hi everyone

I'm currently in the WRAG and CB based and was awarded it on the 6th October 2012, I was just wondering if I qualify for Income-Related ESA for when the 365 day limit expires, because I'm currently volunteering at my local Oxfam and do a couple of hours Monday/Tuesday, currently claim mid rate DLA, Mum looks after me and gets low rate carers allowance and a tad of income support and is seeking part time work/doing voluntary stuff (she has to work round her health, type 1 diabetic), and the general consensus from my Mind support worker and GP is that it may take slightly longer than a year for my recovery because I want to improve and get better, when my Dad died he left the place to us in his will so we don't claim Housing Benefit or anything like that, so yeah to sum up could I be entitled to IR ESA? Personally not confident..

Secondly, there were new regulations bought in on 3rd December 2012 regarding mandatory work related activity, do I continue to receive my ESA under the previous regulations? - Because I'm worried they'll get in touch anytime now via post/phone call and demand I go in and take up voluntary work with a company they have a contract with will I have to worry about this?

Finally, My CB ESA is 365 days, but knowing the DWP, this might not exactly be accurate, any idea when I'll roughly hear from them/what will happen?

We cannot give specific advice on your eligibility for Income Related ESA, but I can tell you the rules.

Eligibility is dependant on your income; if you earn more than than what you would be paid, then you will not be eligible.

Your assets; if you have more than £16,000 in assets you will not be eligible, any assets in excess of £600 will result in a £1 deduction for for every £250, so if you have £7000 then there will be a £4 deduction (7000 - 6000 = 1000 / 250 = 4)

If you have a partner who works more than 24 hours per week, then you will not be eligible.

You should be notified 8 weeks in advance of your ESA(CB) payments stopping, and offered the opportunity to switch to Income Related ESA which will require you to complete an ESA3 form.

Just to point out a typo in Gordon's first post - the lower savings amount, afterwhich IR ESA is reduced, is £6000 not £600!

I gathered haha ;)

And would I be complying with new regulations? as my JCP advisor has pretty much deferred all my WFI's and will get in touch with me again with in the next 12 months to see how I'm doing, and we came to the agreement that as long as I continue what I'm doing with my Mind support worker in the initial interview over the phone and my volunteer work in my local Oxfam shop.
