Completing first ESA form coverting from ICap was created by Gillian Hill
Hi
This is my first post and I couldnt find a releavant answer. I have received the new ESA form on 29th Jan2013 this came out of the blue as I have been on INcap since 1995 had numerous medicals and then in 2003 was told didnt need any more medicals or sick notes.

I am so confused by this form, as I have several embarrassing physical illness but have also developed severe Mental Health Issues. From reading it seems that you only qualify on one or the other. But given the state of physical health caused some of the Mental Health Issues, I dont know how to fill this form in. As some of the symptoms of my MH affect my physical and vice versa.

Any Advice Please the form has to be returned by 23rd Feb and I am finding it confusing. And am petrified about the outcome!!

If its relevant my DLA was reawarded on 7th December 2012 for indefinite time (i know this is meaningless as I will have to apply for PIP.) It was awarded at HRC and HRM which was brilliant after very very years always been either Middle care and lRM for 3 years or even Zero and then appeal................. I finally get a positive result but know it will be shortlived!!! :(

Our ESA claim guides are seperated into physical and mental health to make them more manageable for the claimant. This does not mean that a claimant will only be 'allowed' to have either/or, you should use both guides if you have both physical and mental health problems.

ESA resources

However due to changes that were implemented in January of this year, "It is now only possible to score points for the Physical activities (questions 1-10) if the claimant can show that they have an underlying physical condition, and for the Mental Health ones (questions 11-17), if the can show they have a mental health condition."

Changes to ESA regulations

Nothing on this board constitutes legal advice - always consult a professional about specific problems
