Hi
This is my first post I am new I really need help been diagnosed with severe depression and low mood. I have I had my ATOS in May 2012 and got 0 points. The problem is that when I fill in the assessment for I never actually filled it in it was my daughter 14yrs old who did a quick filling in and missed ques 15/16/17 never even ticked the boxes. Well anyway at my assessment I explained that i suffer depression and unable to go out even to the shops. To cut a long story short this is what the ME pointed out


From the Client Interview
Depression
This mental health problem was caused by family problems
Describes low mood and tearfulness ever day
Sees GP at the surgery for check up, assessment and advice.

Description of a typical day
Does not go to the supermarket because of feeling low. 19 year old daughter will go and do the food shopping, as unable to face going out as she thinks everyone is staring at her.
Daughter accompanies her everywhere, as she constantly feels like she is being watched and judged by everyone around her.
Unable to make appointments with their GP due to feeling low. Is helped by daughter.
All bills are paid by direct debit.
Needed help to complete esa50 due to feeling low. Helped by daughter.

But no assessment was made on my mental health
what should I do for my appeal I can`t go out for help as I don`t talk to people.

I the assessment boxes ME put
“None of the above apply” “I have discussed these activities with the client. The client states that there is no problem with these activities. I have no evidence or opinion to the contrary.”

Please please advice I am falling back into depression.

We will do our best to help, but I am afriad that the bulk of the work must fall on your shoulders (or anybody who can help you), and if this is not practical, then you really need to think about getting face to face advice from your local CAB or Welfare Rights office. I would suggest you do this anyway, but understand the constraints you have, most advice agencies do provide a home visit service, although it can be difficult to persuade them to come out, but it can be done.

The first guide you need to look at is our ESA Appeal guide, this will explain the appeal process and what you need to do, in particular. the following FAQs explain the immediate actions that are necessary

How to submit an appeal

It is important that you appeal in writing, as this will allow you to be paid the ESA Assessment rate until a final Decision on your claim is made.

Once you have submitted an appeal, you need to deal with the issues resulting from your ESA50. Basically I am going to suggest that you create a new one using the information in our Claim guides. You do not need to complete a new form, unless you would find this easier, and you do not need to complete the whole form, just the sections that you believe you should have scored points for. If you only have mental health issues then you only need to look at questions 11-17 and these are covered in the Claims on Mental Health Grounds guide in the above link.

If you able to do this quickly then you should send the information to the DWP as it may be possible to overturn the Decision in what is called the Reconsideration phase, where a DWP Decision Maker will look at all of the evidence again. If this is unsuccessful, then your papers will be submitted to the Tribunal Service for an appeal hearing to be held.

Thank you

I have been reading through all the info.
Just thinking of a face to face even with CAB distresses me.
I do have a doctors appt tomorrow so will as for a letter.
Been suffering from depression for the last year you never really know how it feels unless you have been through it. It can happen to anyone.

Hi Leese
Gordon is correct CAB are very helpful on these matters, they helped me fill in my esa50 was there for a Hour and a half with advisor.
They are very familiar with all the forms so if you feel like your drowning in it get along to the CAB you may have to wait for a appointment took me two weeks as they are so busy but worth it.

Hi
Just to let you know I had my tribunal this monday and as I carnt go out for help i wrote my submission and did alot of reasearch on Benefits and work on how to represent myself.
Anyway was at tribunal and got a right drilling from the judge. had me there for over half an hour :(
At the end he said we will write to you with the descision.
Just got it in my head that i have lost
Got the letter today and won 0 points at assessment and 18 points at tribunal put in wrag. It also says on the letter that I shouldnt be assessed again for 1 year from date of letter which is 25/2/2013 so I quite happy and concentrate on getting better :)

Hi L,

Well done on representing yourself and winning your appeal !!!! :)

Your WRAG award will now be backdated to the time of the fit for work decision that you appealed.

Any arrears owed will be backdated to that time.

I don't want to put a dampener on things but the Tribunal's recommendation that you should not be reassessed for 12 months, is just that, a recommendation, and has no legal standing.

The DWP may or may not abide by this reccomendation, but are not obliged to.

Further, if the ESA that you are receiving is CB ESA only, then this FAQ may be pertinent :

12 Month Limit for ESA(CB)

It may help to speed up any back payment of arrears owed if you send a copy of The Tribunal decision letter to the Benefits Office that deals with your ESA.
