Good Afternoon, could someone please help me with the following... After having my ATOS assesssment, i have had my benefits changed and put on the wrag. I was receiving both higher rates of DLA for 13 years & now they i have put me on the lowest rate of care but kept me on the highter rate of mobility and put me on the ESA - WRAG for 365 days. This i found out via letter last week. Does this mean after the 365 day period i lose my ESA award? and get nothing or go onto job seekers allowance? Or have to find work within this period? Im at my wits end as i can hardly walk, do not drive, need care with meals etc. I have a condition called Arthrofibrosis and arthritis. This has left me with one straight leg. Limited mobility in the other knee joint and limited use of my right arm. I have other underlying conditions like hiatus hernia,sciatica, stomach ulcers and white finger. Ive really been upset over this as i dont know what to do next. Could someone please give me some guidance and advice? Thank you so much in advance David

I assume you are receiving Contribution Based ESA, either because you were transferred from IB or you were working prior to your claim for ESA.

ESA(CB) is time limited to 365 days for claimants in the WRAG, after this ESA(CB) payments will stop, however, you may be able to claim Income Related ESA depending on your income, savings and any hours that a partner works, see

If you were working before your ESA claim, then there is a possibility that you can make a new claim for ESA(CB), however, this is dependant on your NI Contribution history, if you were on IB prior to receiving ESA, then you will not be abe to meet this requirement.

I am afraid the eligibility rules for JSA are substantially the same as for ESA, so if you are not eligible for payment of either ESA(CB) or ESA(IR), then it is very unlikely that you will be eligible to receive JSA.

If you believe you are well enough to undertake work, then there is nothing to stop you doing so, but you cannot be required to work or to seek work while you are in the WRAG.

With regard your DLA award, it sounds like it has been downgraded as a result of your ESA assessment, this is also an appealable Decision.
