ESA50 QUESTIONNAIRE AGAIN ?

ESA50 QUESTIONNAIRE AGAIN ? was created by onlyadog
Hi all been a while since I've been on here but here we go again. I was transferred to WRAG last year from Incapacity benefit, I appealed and after reconsideration was placed in support group in mid April 2012 with the help of a supporting letter from my from my GP. The notification letter stated I would be placed in support group from January 2012, I can only assume this was the date i was placed in the WRAG group. Anyhow my question is this, on the ESA85A it states return to work unlikely for at least two years and as I only went in support group mid-April is it correct I should be filling in yet another ESA50 questionnaire, any advice as always welcome?

Whilst the prognosis on the ESA85(A) is usually used to set the re-assessment date, the DWP are at liberty to assess you at any time after three months have elapsed from a Decision on your claim being made.

So I am afraid, you must complete this new ESA50 in detail and return it by the date date on the accompanying letter.

Can I also make you aware that the ESA Descriptors and Regulations were updated at the end of January so you should make sure that you are using the correct guides in relation to the version of the ESA50 that you have received.

Thank you Gordon for your prompt response. Looking at the new esa50- 001/13 : Question 1, how far can you repeatedly move on level ground without needing to stop, this has changed somewhat from the older Esa50 as there is no longer an option to say you can't move 50 metres without pain and discomfort as mentioned in my doctors report last April. How can I say I can't move this distance repeatedly if it isn't there, If you select 50metres or it varies then that leaves the door open for them to find more excuses, last year I ticked it varies on a lot of the tasks however I won't be making the same mistake and will be basing my answers on how it is most of the time?
Any help?

You should not feel that you have to conform your answers to the form, if a tick box does not fit with the way you want to answer then do not tick it.

You could for example; cross them all out and mark that section "none apply see comment below/attached". You would then explain how far you can move.

Do not forget, you need to explain why you cannot walk this distance and also, why you cannot propel a manual wheelchair over an equivalent distance.

Awarded migration from ICB to ESA +Support Group in September 2012 because of Severe Mental Disorder which is not going to improve.
Just received new ESA50 . Surely this can't be right timing ? I thought it would be years not months .

Hi R,

As I informed you earlier today, each ESA Award in either WRAG or SG comes with a prognosis.

Prognoses can be 3, 6, 9, 12, 18, 24 Months or "In The Longer Term" which tends to be 2 to 3 years.

3 years is the maximum.

"Generally" SG Awards are for 12 Months or more, but you would have to query the length of your prognosis with The DWP.
