I am on ESA (Contribution based). My 365 days have been used and I am now in receipt of no money as my partner is in a fairly well paid job. I did Permitted work last year and was told I can only do this on the higher rate for 52 weeks. The 52 weeks expire in March and I have read on the internet that I can only earn £20 on the lower. (or wait for another 52 weeks to pass) I appreciate they can set these restrictions to £20 if your in receipt of some money, but my 365 days are up and I dont get anything. Am I still therefore restricted to what I can earn? If this is the case, how can they give you restrictions when they aren't even paying you any money. Please help me on this because my therapist is trying to encourage me to do something so I can get more confidence.

I think you need to get face to face advice.

Although payment has stopped, you are still classed as having Limited Capability for Work and as a result, techically are still in the WRAG and subject to the rules concerning PW, however, since there is no ongoing payment, it is difficult to see how the DWP can argue against it.

The underlying concern has to be what what happens (a) to payment of NI Credits that count towards a full State Pension, and (b) the option to be re-assessed at a future date should your condition deteriorate and you become eligible for the Support Group, are you risking these rights by continuing PW?

Thanks for that, but the information in the link doesn't really answer my question.

I have used up 52 weeks of permitted work on ESA(Contribution based) where you can earn up to £95 per week and work for less than 16 hrs. I am still on ESA (Contribution based) but I no longer get any money for this benefit as I have been on it for more than 365 days. As I am in receipt of no money for ESA but remain on this benefit, can I do permitted work again and how much can I earn? Remember I am getting now money for ESA now as it is restricted to 1 yr Contribution based) ?

The website states that if you are on ESA and do permitted work on the higher rate of £95 then you can only do this for 52 weeks. After this, you need to wait another year before you can go on the higher rate again. It states you can earn £20 though. As I am no longer getting any money on ESA, I am still restricted to this £20 or can I earn a bit more?
