ESA - CAN I SWOP FROM CONTRIBUTION BASED IRB

I am currently on CB ESA and I am in The SG.

I have just sent in a review form ESA50, I have MS and poor mobility and balance.

If I am not replaced into the SG then that means 52 weeks.

My husband who is 60 has work that only lasts 4/5 months. Can I then change to IR ESA ?

Also what happens if he then gets back into work and I change back to CB ESA ?

Do they count all the weeks up of both CB ESA and IR ESA to = the 52 weeks ?, and if so, what happens after 52 weeks if I need IR ESA ?

Hi D,

Any time spent in The SG, whether in receipt of CB ESA or IR ESA or both, does not count against your 365 day entitlement to payment of CB ESA.

Any time spent in receipt of IR ESA in either group does not count against your 365 day entitlement either.

Time spent in receipt of CB ESA only in The WRAG does count against the 365 day entitlement to payment.

This time is added together cumulitively, so it could be from one award of WRAG (CB ESA) for 9 months and another for 3 months or more.

In other words you only get the 365 days of payment of CB ESA in The WRAG once.

If you were in a situation, where your household income varied across a period, such as the scenario that you mention, and you had exhausted your entitlement to CB ESA, then you would have to inform the DWP about any such change in circumstances, they would then reassess your financial circumstances with respect to capital, assets, savings, and household income to see whether you could pass the Means Test that entitled you to payment of IR ESA.

So if there was a scenario where your CB ESA had ceased, and payment from your husband's job put your household income above the amount allowed, then you would not receive any payment.

You would have to inform The DWP every time that your circumstances changed.
