Hi, I am hoping someone can help me.
Been awarded ESA SG and DLA on basis of spinal stenosis from an accident (have MRI results telling me so). The Dr's have now decided it isn't stenosis and it's degenation of the spine. They have agreed that no matter what you call it, it's still the same pain and mobility problems and pain relief treatment.
My question is what do I tell the DWP, will I have to cancel the claim and start again as its a change of circumstances or is it just a change of information?
Both GP and Pain Management Dr's have agreed they would write supporting letters. I know I have to tell them, just what do I tell them so I don't make things worse than they need to be?
Any advice would be gladly received.
Thank you

Hi,

In my opinion, this would not effect you current awards of ESA and DLA.

ESA is awarded due to "Limitations" suffered as a result of any particular medical condition, not for the medical condition itself. (except in some case with Exceptional Circumstances rules)

DLA again is not awarded for any particular medical condition, it is awarded for Mobility Limitations, and Care Needs.

If non of the limitations or care needs as mentioned above, have diminished to such an extent that you may no longer qualify, I do not see it necessary to inform the DWP.

It is of course up to you, as to whether you consider this worthy of reporting as a "Change in Circumstances". :)

In addition to bro's excellent advice, I note that your forumname might be your real name. Many people prefer to use an alias on a public forum like this. If you wish to change your username, please follow the instructions in this FAQ

Nothing on this board constitutes legal advice - always consult a professional about specific problems
