Hello,

What are the regulations 29 and 35 and where can I find them? I am in a similar situation to you and don't think I've made such a good job of informing my GP etc as you :(

ESA Reg 29 for entry to WRAG. (LCW)

&

ESA Reg 35 for entry to SG. (LCWRA)

Also covered in our : ESA Claims Guides

The new amendments will also take into account whether the "Substantial Risk" can be reduced by taking prescribed medication, or by making "Reasonable Adjustments"

28/01/13 Ammendments to ESA REG 29 :

"Paragraph (6) amends regulation 29 (exceptional circumstances where a person may be treated as having limited capability for work) so that the definition of “substantial risk” in regulation 29(2)(b) excludes circumstances where the risk to health could be significantly
reduced by reasonable adjustments being made in the workplace or by the claimant taking prescribed medication."
