Must be quickest dla decision ever !!

Hi

I am absoloutly amazed at the time it took for a dla decision to be made. I posted it on the monday,on the friday i had a letter from dwp saying i hadnt been awarded anything. Turnaround in less than a week ??? is this possible? The reasons given were the exact opposite of what had been written on the form ! Did they simply not bother to read all the documentation that was sent with the claim form? Absoloutly unbeleivable !!!

These people make so much work for not only themselves but also us. What a farce it is all becoming. Must be costing them more to sort out appeals etc !!

I have had to put in for an appeal. So have to start the whole process over again. When will this all end ! :(

I have seen this happen a couple of times, it is usually on new claim, does this apply to you?

You can either appeal this Decision or make a new claim for DLA, but even if you choose the latter, I would request the documentation from the DWP on this Decision, it could be that there is a fundamental flaw in the way you have approached completing the forms, which you obviously might repeat. Even though you have no medical the following will give you an idea of what documents might be available.

I recently had to reapply for DLA after having come to the end of my previous five year award. I filled in my DLA form with extensive information and reports about my conditions (far more comprehensive information, incidentally, than I supplied on my initial application when I first applied five years ago when I was awarded higher care, mid rate mobility). Within five days, I too got a reply and complete dismissal of my claim.

Their review of my application stated that they took into consideration my ESA medical report from early last year (a report that was, again incidentally, filled with serious inaccuracies and which to any fair minded person constituted medical negligence). Their listed statement of reasons for DLA dismissal was shockingly inaccurate and disheartening.

I instantly requested that they initiate a reconsideration of my application as I believed they had failed in their duty of due care and consideration of my application, especially considering the speed with which my application had been refused. Should they fail to do that, I informed them I would like them to instigate Appeal procedures.

I received a reply this week that my reconsideration decision was delayed as they were requesting a medical report from my GP – which of course I supplied with my DLA application. Their request begs the question, how did the DWP make such a rapid decision of dismissal on my DLA application when in fact they had not even approached my GP for the level of comprehensive evidence necessary to make such a decision?

I await their decision.

Meanwhile, today I received a new form from the DWP for ESA (I'm currently in the support group) requesting that I need to reapply for ESA again as a year has lapsed since my last application. I'm not sure I have the strength for the whole procedure of extensive form filling and the inhumane and deeply flawed ATOS medical again. I feel almost psychologically and physically defeated by the incessant stress, intrusion and cold hearted cruelty of it all. Why this wicked debasement of the sick and vulnerable? Why the assault on those most in need? It's criminal.
