ESA appeal tribunal submisson was created by nik
hi there I am just going through my appeal papers for ESA tribunal.

There will be more evidence and and a submission detailing my appeal which i want to be considered in the appeal.

i have been advised by CAB that it is better to take it with me on the day.. and is more likely to be successful .
Rather than sending it in advance ( whereby they would have time to bounce it back and forth with DWP prior to the hearing)

Have you any experience as to which is better?

Hi Nic,

The tribunal usually ask for everything to be submitted at least 2 weeks before the date of the hearing. They might accept something on the day, but they are not obliged to do so. It is an integral part of British law that both sides of any dispute see all the paperwork beforehand. There is also the fact that a strong submission might bring about an early decision and stop the case needing to go to tribunal.
