Hi Gordon,

I contacted my neice and the paperwork came from DWP, so do you think i,m still at reconsideration phase, also it looks like i,ll have to represent myself at the tribunal, can i take someone with me for support? also what happens if i loose the tribunal which i,m fully expecting as since this time last year nothing has gone in my favour at all with the migration from IB to ESA.

It sounds like you are, but I would give them a call as 8 months is an excessive time to wait for the DWP to look at your claim again. If this is the case, then you might want get your MP involved, see

Contacting your MP

Yes, you can take a companion, just make it clear that they are providing emotional support only.

I am afraid I cannot tell from your previous posts whether you are appealing a FIt for Work Decsiion or to be placed in the Support Group?

If the former, then your current payments will stop, but you should be able to make a new claim for ESA if your GP is still prepared to support you. See below.

If the latter, then your WRAG payments will continue. See below.

Note: If you are receiving ESA(CB) then in both of the above cases your payments will be limited to 365 days after which you will no longer be entitled to payment unless you are eligible to receive ESA(IR) which is subject to a means test of income, savings and assets, and any hours that a partner works.

Thank you Gordon,

I am appealing a fit for work decision, and yes 8 months is a long time, but i,m lead to believe that the DWP office that deals with my case is inundated and has been for quite a while.

If you can understand me ive been burying my head in the sand by not making contact with them or my MP as my anxiety and depression are through the roof, in an ideal world i just want to left alone to languish on my £71 a week lol no partner to support me either.

Hi to all Mods,

Well it seems i must have had a reconsideration without being informed, plainly obvious that it did not go in my favour(nothing new there then), i have had the CTS papers , so iv'e got 14 days to send a submission with the enquiry form, to be honest i don,t know where to start, i know iv'e got nothing to loose as i'm appealing a fit for work decision, but i'm in a real state never mind the letter states that the appeal won't be heard for at least 40 weeks because of the high volumes of appeals, any advice of what i should send with this enquiry form would be great.

The DWP usually inform the claimant that their Reconsideration has failed by sending their Tribunal pack :(

Technically you have one month, not 14 days, to send in any evidence and/or a submission, but the reality is that they will continue to accept documents up to a couple of weeks before the hearing.

The 14 days applies just to the form.
