Hello and goodmorning to you.



i have just subscibed to your amazing site, but i am unable to use it correctly. i would like some details on ESA as i have crohnes disease and at present bleeding from by bowels. i also suffer from other ilnesses as well/ i was put in the work related group and they are pressuring me to attend the meeting. i have asked wether they have the facilities of toilets in which i can use whilst being at the job centre, i was told no as its like going to a bank were the banks dont cater for toilets. i then said to sue my bladder or bowels do not run on a times table.



i asked the advisor wether she could come out and visit me, she also refused. i did mention i have a letter from the chrohnes and collitis organisation requestin of the job centre to give me access of the toilets when needed whilst being in the work related group at the job centre. the letter was also dismissed as well as the home visits.



she said she need to see me at some point and her hands are tied. Sue has now left me for 6months untill june 13. should i take this matter to a manager

I am afraid this is something of a Catch-22 :(

As you are in the WRAG, you are required to participate in Work Related Activity, whilst any requests must also take into account any limitations that result from your conditions, ultimately, you cannot be excused.

There may be some leeway under the Equality Act, which covers disability discrimination, however, this subject has been raised before and as most JC+ offices to provide any toilet facilities to claimants, disabled or not, it may be difficult to bring a case, or even threaten them with one.

One positive activity you could look at would be to involve your MP, whilst their ability to intervene is limited, it is surprising how often matters are progressed and resolved when they become involved.

I think your idea of escalating the issue is a good one, I would suggest you approach it from the point of view of JC+ accomodating your problems, so you are seen as trying to helpful.

As you appear to have a few months before your next meeting, heopfully this matter can be resolved, before it becomes an issue.

Hi B,

If you feel that you should be in The Support Group, (SG) you have one month from the date of the letter informing you that you were in The WRAG to appeal.

If you have missed this one month deadline, you can make a late appeal upto 13 months after the decision notice, but you will have to show good cause for the late appeal.

In either case, you can appeal using The GL24 Form, which can be downloaded and printed off from the link on this page :

Are you aware that if the ESA paid to you in The WRAG is Contribution Based (CB) ESA only, you will only receive 365 days of payment, unless you can gain access to The SG, see :

Finally, as The DWP and/or any Works Provider are "public service providers" they are obliged to make "Reasonable Adjustments" for disabled people who visit their premises, especially if they are compelled to attend. This may include such things as Disabled Toilet access, etc, etc.

This is covered under The Equality Act 2010 :

I think "Reasonable Adjustments " are covered under sections 20, 21 and 22 of EA2010.
