Support Group - Backdated Payments

Support Group - Backdated Payments was created by DandyBoy
On appeal in Feb'13 the Tribunal placed me in the Support Group (only following all the great help from this site & 'the mods' :-) ), setting aside the DWP decision dated 24.11.2011. Since then the DWP have taken a while to catch up processing the paperwork.

Since the Tribunal they have demanded a further Med 3 - i simply sent them a further copy of the Tribunal decision stating i didn't think one was required given the Tribunal' decision.. They again threatened to terminate ESA transitional payments without a Med3. I again sent a 2nd copy of the Tribunal ruling saying i did not believe a Med 3 was required.

I then had an 'or else' letter from the DWP for a Med3 by 07.03.- so i sent a Med 3 - tracked & traced, & it did arrive on 07.03. The DWP then stopped all payments a day earlier on the 6th anyway.

Then catch-up began - all dated 06.03. - (the same day that they ceased payments for a med3 demanded for 07.03.) - i received two separate letters for backdated cold weather payments.

I then received an ESA72 letter also dated 06.03, stating i was being placed in the Support Group.

I received a further letter also dated 06.03 confirming how payments were to be calculated.

They state they will pay me £113.90 ESA from 15.12.2011 (the set aside date was 24.11.2011 a month earlier). Should it commence a month later ?

On the back page they provide a break down of the payments - thus
Living Exs - £67.50 -
Extra money for Disability Income Guarantee - £14.05
Support Group - £32.35
Total £113.90
and they state this will be paid from 15.12.2011 to 11 April, 2012 ?
I assume they then deduct the transitional ESA payment that was made and credit the balance - is this correct ?

Why only April 2012 - did something change then ? I have tried scouring the various sections but admit to feeling lost. Is this just another typo, or is 2012 > 2013 dealt with separately ?

Am i to expect a further letter detailing April 2012 to present day, 15.03.13. less transitional payments ?

Hi DB,

As any decision made by a Tribunal as the result of an appeal is in fact a "Remaking" of the original adverse decision that you appealed.

The Tribunal's decision should be backdated to the date of the adverse decision appealed.

Any subsequent arrears of benefit should also be payed from that date.

April is the month when Benefit Rates are uprated annually, this could explain the differing amount of money, the £67.50, and the other rates that you quote were the pre April 2012 rates, the £67.50 increased to £71.00 post April 2012.

Muchos gracias 'bro58' ... have already written to them (recorded delivery) along these lines and sought explanation to ensure any query is made 'within the month' stipulated in the letter.
Will check Royal Mail 'track & trace to confirm delivery.
