stick with WRAG decision or appeal for SG?

i think i can make a good case for appealling the decision given this month to place me in WRAG based on the IB/ESA transfer assessment last november 2012. yet as i've had some improvement in mental health or at least recovering a bit in last couple of weeks, i thought i might try WRAG. the outcome of an appeal may come after my next ESA medical assessment in november 2013. by then i could be severely (mentally) ill again- it's a cyclical condition. should i try WRAG now or take the opportunity to make a realistic appeal based on my retrospective condition at november 2012. my condition will worsen again year (if as last year), especially with exposure to stress. which is the least stressful way forward? thankyou for any advice- i'm quite confused and terribly anxious about this.

Hi p,

The decision on whether to appeal or not can only be made by you.

However, if you did appeal, you would be asking the DWP/TS to re-look at whether your conditions and resulting limitations should have resulted in an SG award at the time of the adverse WRAG award.

Not on how you are, or may be at some time in the future.

Of course you are obliged to inform the DWP of any improvement in your health conditions, if such improvements may mean that you no longer qualify for the ESA group that you have been placed in.

You should consider how you are for the majority of the time, and whether any such improvement is temporary, etc.
