In support group after appeal - what now was created by FoxyLady2
well it is almost 6 weeks since the tribunal ruled that I should be in the support group - I've got the paperwork from them giving their ruling - but nothing else - nothing from the DWP and am still getting paid as if in work activity group.

Can I safely just leave it to the DWP to eventually sort it out - does it usually take this long to get paperwork from the DWP and back pay etc?

Can I use the tribunal paperwork to send to the Job Centre to cancel the WFI appointment that they have sent me?

I really don't want to contact the DWP unless I absolutely have to since I am scared that they will just start the whole assessment process again - can I just leave it or is their a risk that the tribunal ruling won't be accepted if DWP have lost it or something

Hi FL2,

Congratulations on being placed into The SG at appeal.

The DWP should eventually get round to updating your file, with regards to The Tribunal decision.

However, this can take many weeks. Therefore, if you wish to try and speed this process up, you could post a copy of the Tribunal's decision notice to the DWP Benefits Office that has been dealing with your ESA.

You no longer have to attend WFI's or take part in WRA unless you wish to do so voluntarily.

Therefore, you could ring the JCP Adviser, informing them that you are now in The SG, and that you do not wish to take part in WRA. (if that is the case)

You could also post copy of the decision notice to the JCP Adviser if they query your new SG status, as it is highly likely that their systems will not have been updated either.

I just really wanted to know whether 6 weeks without any response from them meant that there was a problem that I needed to do something about.

Hi FL2,

Yes, that should be enough to stop the JCP compelling you to take part in WRA.

The Tribunal Decision now stands, and will be backdated to the date of The WRAG award that you successfully appealed.

Therefore, it will be as if you were never in The WRAG for that period.

It is of course up to you on whether you wish to try and speed up the updating of your ESA file, we have heard from members where this has taken many months though.

Hi FL2,

Did the Tribunal make a recommendation of how long it should be after their decision before you are reassessed ?

If they did, even though it is only a recommendation, and has no legal standing, some members have used these recommendations as leverage recently by involving their M.P.'s, where The DWP have tried to reassess them soon after the Tribunal's decision.
