hi can you help
Ive been sent a pink ESA 50 01/13 to fill in
but i will be telling them that i have a additional problem from last time i claimed (incapacity benefit, sever disabled benefit)
i also receive DLA with a indefinite award
so i will be informing the DLA about the additional problem
what my question is
will i have to make a claim for PIP ?
if i do will i be one of the first ones to claim for it ?
if i am is it worse because i am one of the first ?
is it better to be one of the first ?
(i say that because of them making it harder claiming ESA if your not one of
the first ones)
PLEASE HELP !

Hi jlg,

It appears that you are being migrated over to ESA from another benefit, in which case you should read our :

IB, IS, SDA, Migration to ESA FAQ’s

You should be aware that ESA is a totally different benefit to IB or SDA, and has very different, stricter qualifying criteria.

As you have now received The ESA50 01/2013, you may wish to consider : Using The PDF Version Of The ESA50 Questionnaire , this page is from our : ESA FAQ’s , which you may also find informative.

You should fill in the ESA50 whilst referring to the "NEW ESA50" Guides, on this page :

If you are currently in receipt of an indefinite award of DLA, you should not be invited to apply for PIP until after October 2015.

If you request a review of your DLA due to a change in your circumstances before October 2013, you should be reviewed under DLA criteria, if after October 2013, you would be reviewed under PIP criteria.

If you do not have review of your DLA as above, the only other way that you may be reviewed would be under :

The Right Payment Programme .

i have read most of the info you have as i have been a member for several years
i am just worried that because its so close to the cut off time
that they may not get round to looking at my change in circumstance DLA claim
so i have to claim PIP
so in your opinion do you think
i will be one of the first ones to claim for it ?
if i am is it worse because i am one of the first ?
or
is it better to be one of the first ?

Unless you are in one of the trial areas, the DWP will not begin moving DLA claimants to PIP until, at the earliest, October this year, so I think it very unlikely that you will be transferred to the new benefit if you intend to inform the DLA unit of a Change of Circumstances now.

Also, and I say this without knowing what your new condition is, you are assuming that your CofC will result in a re-assessment and this may well not be the case, for example; if you currently receive Medium Rate Care, you will only be moved to Higher Rate Care if you can show that you now need care both day and night, requiring more care during the day or the night will not result in an increased award.
