New ESA form.

New ESA form. was created by Brian Johnson
I was originally put in the WRAG group back in July 2012, but after further complications have decided to appeal to join the 'support group'. This form seems just like the last one, is this
usual ? or am I missing out on something more sinister. ?? Help , please, I have to submit the form
in April.Since I have trouble navigating aroudn this site (still all new to me) - I would dearly appreciate any advice going to my own e-mail -[deleted by moderator] or on here too, if I can find it !!

Hi brian,

Please will you confirm whether you put in a late appeal or whether you asked for a new decision due to a recent worstening of your condition?

If you put in a late appeal I would not expect you to be sent another ESA50 unless it is time for a routine reassessment. If you asked for a revision (a 'supersession') ,due to a deterioration in your condition that has occured after the original decision, this would prompt a new ESA50 and possibly a face-to-face assessment.

Thanks for your reply - I have appealed after further medical problems have developed and
rather carelessly forgot to include a consultant's report in the initial response. The form is 'Limited
Capability for Work Questionnaire' (ESA50 01/13), and seems to ask me to duplicate all the stuff
I have already sent out before. I attended one WRAG group session and was told there would be no more to attend.(I have complied with their rules completely). The meeting was a waste of time,
and I was treated with cold indifference.

If you have lodged an appeal, then this ESA50 has been sent to you as part of a re-assessment of your claim, and is separate from any appeal that you have made, so you must complete this form in detail and return it by the required date.

You also need to be aware that the ESA50, the ESA Descriptors and ESA Regulations have been updated since you last completed one, so you should make sure that refer to the correct ESA Claim guides in the Members area.

With regard your appeal, you say "I have appealed after further medical problems have developed", if these new problems developed after the date of the Decision you appealed, and in particular after the associated assessment, then they cannot be considered by the DWP during the Reconsideration stage of your appeal, nor by a Tribunal Panel at an appeal hearing.

If this is not the case then it is essential that any evidence related to these "problems" makes it clear that you were affected by them at the time of your previous Decision, as you risk them being ignored, as above, if they do not.

Many thanks for your reply.One condition goes back years,and is very intermittent,but certainly
is 'there for good', and the other conditon I knew that I had at the time of filling in the first
form, but of course I can't diagnose myself. I hope that this is a bit more clear. My brain isn't alway in first gear at the moment, and I hope to goodness that there is hope yet !!!

This should mean that they are considered as part of your appeal, but as I said earlier, it is essential, especially for the second condition, that any reports or evidence make it clear that you were suffering from it at the time you were assessed.

Please remember that there is a fixed timescale for sending back the ESA50 you have received.
