Work Focussed interview for Partner Concerns

Please could someone advise me. I have just been put into the support group (thanks B&W) I also receive DLA. This morning I received an award notice saying that my wife may be asked to a WFI after 26 weeks because part of my ESA is because I have a partner. Two questions, how many of these WFIs must she attend and secondly she has said that if they are planing to hassle her while she is busy caring for me she would rather they stopped her money and left her alone. Can anyone tell me if she doesn't attend if they will stop all of my esa or just the amount they include for her. Thank you all.

I am afraid that when you are receiving a ESA(IR) as part of a joint claim, the your partner can be required to attend WFIs as a condition of you continuing to receive the benefit.

A failure to attend can lead to a sanction of the ESA Personal Allowance, currently £71.00, this sanction remains in place until the requirement is satisfied. also, you cannot remove her from your claim, so it is really important that she attend if requested.

However, you say she is your carer, is this official in that she receives Carers Allowance? Even if it is not, if she explains that this is what she is doing then the advisor should not want to see her more than once a year, and possibly even less.

She should not be required to participate in Work Related Activity.

Thank you Gordon, I appreciate your comments. I receive the lower rate care component DLA and also DLA mobility component lower. My wife is really my full time carer and I have explained this among other things in my ESA 50 which they have accepted and put me into the support group. I would really be lost without her help and the fear we have is that they will force her into workfare or something. Can they do that Gordon?

No, she should not be required to participate in Work Related Activity or the Work Programme.

When, and if she receives an appointment, she should contact the advisor and explain her situation, it may be possible for the interview to be cancelled, although this is rare for the first one, or to be held over the phone.
