Hi all,

I am new to this site and was wondering can someone explain why the DLA have reached this decision of low Care?

How or what makes a low care decision?

I am not sure what to do as I beleive I should have higher care?

What do i do to fight this? Help
Thanks

Hi D,

Welcome to Benefits and Work :)

The qualifying criteria for Higher Rate Care Component of DLA stipulates that care is "Reasonably Required" throughout the day and the night.

To gain a better idea of how and why you were only awarded LRC, you may wish to request any documentation that was used in coming to this decision, see : DLA Medical – What forms to ask for?

You can do this by issuing a SAR :

www.dwp.gov.uk/docs/request-for-personal-information.rtf

From this page :

www.dwp.gov.uk/privacy-policy/data-protection/

If you wish to appeal this decision, you have one month from the date of the DLA Decision Notice letter. This can be done by downloading and printing off a GL24 Form from this page :

How to submit an appeal

From our : Appeals FAQ’s

As you will see in the above FAQ's there is some risk involved.

As requested documents using a SAR can take up to 40 days to arrive, you should not miss your one month deadline to appeal if these have not arrived. You can always state in the GL24 that you have requested the documentation, and will provide more evidence if appropriate when you receive it.

To give you a better understanding of how and why you may have not been awarded HRC, you should review our : DLA Guides

You will also find an appeals guide on that page.

You may also find it helpful to view the information on the links below :
