Hi Guys
Iam back on again about these NICB after the 365 days are finished.

Have a look at this I found on a CAB web site, and let me know what you think especially about the bit about `any tax year`.

Contributory Employment and Support Allowance and national insurance contributions

The first contribution condition for contributory Employment and Support Allowance (ESA) is that you must have actually paid Class 1 or 2 national insurance contributions in one of the last three tax years before you claim. However, you may be able to satisfy this condition with contributions paid in any tax year, if you haven’t been able to pay contributions recently - for example, because you were getting Carer’s Allowance or Incapacity Benefit, or if you were getting Working Tax Credit with a disability element before you became incapable of work.

The second condition is that you must either have paid or been credited with contributions for the last two tax years before you claim. However, credited contributions will not always count towards this condition.

The contribution conditions for ESA, and when they can be relaxed because of your circumstances, are very complicated. If you have had limited capability for work since you were young, you may not have to satisfy any national insurance contribution conditions at all, and you will get contributory ESA without any NI being paid or credited. If you do not meet the contribution conditions for contributory ESA, you may still qualify for income-related ESA if your income and capital are low enough.

This was abolished as part of the Welfare Reform Bill. It is posible that you are looking at an old web page.

We have had a similar discussion with another member, but as I said to them,

"I am afraid that you may be looking for an answer that isn't there" :(

RECLAIMING CB ESA :


"In order to qualify for ESA(CB) after your previous claim was time limited, you need to meet three Contribution Conditions. The following is a simplified version

1, You need to have 12 months of NI Contributions in the two preceding tax years to the current benefit year.

2. You need to have two years of NI Contributions and/or NI Credits in the two preceding tax years to the current benefit year.

3. One of the years used must be later than the years used in the original claim.

The Benefit year is 2013.

The tax years are 2010-2011 and 2011 and 2012.

You will meet the requirements for (2) and (3) due the payment of your IB/ESA from which you received NI Credits.

You cannot meet the requirements for (1) as you will not have accrued any NI Contributions during the relevant tax years. NI Contributions can only be accrued by paid employment or registered self-employment.

No one who was previously receiving IB will be able to re-qualify for ESA(CB) without them working as they will have no NI Contributions in the relevant tax years."

Its hard to accept that after 365 days that I wont be getting any benefits at all even although I have well documented health problems.

Maybe one day somebody will find a Rosetta stone to dechyper the ESA hieroglyphs
