Esa appeal? was created by jamieupanddown
Hi, I was wondering if anyone can help me with my Fathers appeal. He is 63.
He had a farm accident when he was 18 y.o and suffered for many years with his legs, (they were close to amputating both legs at the time) he worked as a farmer until the age of 36, when he had a few operations to lock his ankles so not much movement. He now suffers with arthritis in both legs. He receives industrial injuries which is indefinate, he claims incapacity benefit and receives the higher mobility DLA. He also suffers with polymyalgia which he is on steroids for, he has painkillers for his legs, suffers from arthritis in the neck which he is waiting for physio, and has had mental health problems which he was in a psychiatric ward and had the electric shock treatment but is not currently taking any medication for now.
He received the form to claim ESA, which I downloaded the guide from this website to help them fill it in. He heard within a week and had to have a medical which didnt go too well as my father is too gullible and tried to do his best after the nurse gained his trust. He scored 0 points in everything!
Where does he go from here? What is the best thing too do? He cant get an appointment with a benefits advisor until the 12th of April, so should I write in explaining that they are to appeal but need time to get a medical report from my fathers gp then take it from there or wait until the 12th of April and go from there.
many thanks in advance Ceri.

P.S on a slightly better note my husband went straight from IB to Support group, i think without the help and support from your guides would of been a near impossible task due to the new system put into place by our disability friendly coalition......

Hi juad,

If your father wishes to appeal the fit for work decision, he must obtain a MED 3 "fit note" from his G.P. to cover him from the active date of the 0 points decision.

He must then send this in to the DWP, (keep a copy) :

Sending Documents to the DWP or ATOS

He must then also submit an appeal using GL24 Form which can be downloaded and printed off from the link on this page :

How to submit an appeal

From our : Appeals FAQ’s

This must be done within one month of the date of The ESA Decision Notice letter.

Once the above has been processed by the DWP, he will then be entitled to Assessment Rate ESA whist his appeal is ongoing.

Have another look at our : ESA Claims Guides which includes an ESA Appeals Guide.

From our : ESA FAQ’s

You could also request the ESA Documents that were used in coming to the 0 points decision, which will include an ESA85, and an LT54 :

ESA medical – what forms to ask for?

ESA Forms

You can do this by issuing a SAR :

www.dwp.gov.uk/docs/request-for-personal-information.rtf

From this page :

www.dwp.gov.uk/privacy-policy/data-protection/

Don't miss the one month deadline if any requested ESA documents have not arrived, you can always send in any relevant information when they do arrive.

Great news about your husband, thanks for letting us know, and for your kind comments. :)

Hopefully you will gain a positive result with your father.
