High DLA but ESA Zero Points?

Hi Folks,

How can this happen?

I am on high DLA for care & mobility indefinably but I have just had my appeal bundle of papers from the DWP & I have been awarded no points. My previous DLA claim was only last summer & I have used the same supporting evidence.

There's plenty evidence from spinal surgeons, letters from other consultants & medical reports etc

The only thing in the paperwork I can see which wasn't in the last lot of papers is the GP's section which is rather vague, but still backs me up. However she does have a diagnosis of a physical condition I am unaware of & would disagree about. She also has listed my bipolar disorder as "occurring depressing disorder"

She's written "confined to home" Yet she ticked yes to travel by bus or taxi.

I've only seen her once since moving in 2008

Q, Can I request a medical at this stage?

Any help would be gratefully appreciated.

Hi Solstice, I am sorry to hear that you have been found ineligible for ESA. This is entirely possible, even though you are on high rate DLA as the criteria for ESA are more stringent than for DLA.

I am afraid that you are not entitled to request a face-to-face assessment.

As you mention the 'appeal bundle' of papers then it seems that the mandatory reconsideration did not find in your favour and you are now awaiting a date for the tribunal. You should have a good look at the descriptors for ESA and see if you can get together any further evidence in your support. This should now be sent to the tribunal service rather than DWP.

It may be that you were awarded WRAG under the 'exceptional circumstances' rule?
