Confused was created by Hlneve
I was put in the Esa Wrag in July last year and recently received a letter telling me my Esa finishes in August .I had a interview at Job Centre last week and asked about this as I was not aware that there was a 365 time limit on this .I also asked about the possibility of transferring to the support group as I have recently been told I have to have surgery on my hip to remove a bursa and also face the possible surgery to fuse my left ankle and also to debride my Achilles tendon .The advisor told me that I would be entitled to nothing once my 365 days are up and that the same time 365 limit applies to the support group so would get nothing if I was transferred .I have had a couple of interviews at the job centre regarding returning to work and this last one was to discuss the possibility of working from home as I feel the way my condition Fybromyalgia and osteo artritis affects me day to day basis is the only suitable way forward at the present time the advisor was more interested in telling me what they could pay for in the way of buying me machines etc to start me working and telling me that if I did take up the offer that I would have to agree to sign off date then I would also be put on the Enterpise scheme all this has my head spinning and totally confused any help would be appreciated

With your new conditions, it might be worth asking for a 'supersession' of your ESA claim if you think you now meet the Support Group criteria. This would, in effect, start the assessment process all over again with an ESA50.

Qualifying for the Support Group

If you are awarded Support Group ESA at any stage, either now or after a future reassessment, your payments will restart - as long as you have not ended your ESA claim in the interim. You will still be classed as being 'on ESA' and get Ni credits even though you are no longer getting payments. Time in the Support Group is not time limited.

Yet another case of the advisor needing advising!!!

Very worrying.

Good luck with your case.

It is up to you - you can either way until the July reassessment (which will, in effect, be the same as a new claim) or you can write to the DWP office dealing with your claim and tell them that, as your condition has worstened, you want a 'supersession'.

thank you I was given the impression that the reassessment in July was to do with the end of my claim the following month and it would not effect anything .
